Business Guidebook: How to Mediate Employment Disputes under Thai Labour Law 2021
The Guidebook promotes the use of Alternative Dispute Resolution Mechanisms (ADR) in Thailand as an effective channel for improving remediation outcomes for all workers, including migrant workers.
It also explains the processes for state-based grievance mechanisms and ADR mechanisms under Thai law, and presenting benefits ADR offers to both workers and employers. The document aims to support employers of migrant workers in Thailand, especially human resource, compliance, and sustainability staff to be informed about employer obligations under Thai law and grievance mechanism procedures for application.
Developed as a result of cooperation between the Ministry of Labour of the Royal Thai Government and IOM, this Guidebook visually explains, for the first time, the processes for State-based remediation and provide better understanding of:
(a) The process before the labour inspector/labour court;
(b) The process of in-court mediation;

(d) The key offences under the Labour Protection Act together with the corresponding penalties.
The Guidebook is also available in Thai.
